  The new Land Owner Transparency Act ("LOTA") now requires that each registered owner ("Transferee") must declare whether or not they are a Reporting Body, necessitating further documentation of non-registered interest holders. This is automatically the case for entities such as corporations, partnerships, and documented trusts, while individual persons holding both the registered AND full beneficial interest in the property would likely not be considered a Reporting Body. Transferees planning to hold an interest in the property on behalf of a non-registered beneficial interest holder, however, may be considered a bare trustee and should obtain appropriate tax and other such advice in this regard before determining whether or not they are a Reporting Body.
